Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Poketrax website and application at poketrax.co.uk (the "Service"), operated by Strife Solutions Ltd (trading as Poketrax) ("Poketrax", "we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service
Poketrax aggregates and displays pricing, sales-comparable, and population data for Pokémon Trading Card Game cards from third-party sources, and provides tools to track your collection, wishlists, deals, and grading recommendations. The Service is an informational tool only.
Poketrax is not affiliated with, endorsed by, or sponsored by The Pokémon Company, Nintendo, Game Freak, or any data source we aggregate. All trademarks, card names, and images are the property of their respective owners.
3. Accounts
You must be at least 16 years old to use the Service. You are responsible for keeping your login credentials secure and for all activity under your account. You must provide accurate information and notify us promptly of any unauthorised use. We may suspend or terminate accounts that breach these Terms.
4. Subscriptions, trials, and billing
4.1 Plans
The Service offers free and paid subscription tiers. Paid features, quotas (such as data-refresh limits), and pricing are described on our pricing page.
4.2 Free trial
We may offer a 14-day free trial of a paid plan. If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged the applicable fee unless stated otherwise at sign-up. At trial expiry without payment, your account is downgraded to the free tier.
4.3 Payment
Payments are processed by Stripe. By subscribing, you authorise us (via Stripe) to charge your payment method on a recurring basis (monthly or annual, as selected) until you cancel. You agree to Stripe's terms in addition to these Terms.
4.4 Founder pricing
Where offered, "founder" pricing is a limited-availability rate (subject to a seat cap). Founder pricing is "for life": once you have subscribed into a founder seat, you retain founder status and pricing for as long as your account exists, including across a cancellation and re-subscription, subject to these Terms. Founder seats are limited and offered on a first-come basis until the cap is reached.
4.5 Renewals and price changes
Subscriptions renew automatically at the end of each billing period. We may change prices for future billing periods; we will give you reasonable notice and the change will not affect founder-rate eligibility where it applies. Continued use after a price change constitutes acceptance.
4.6 Cancellation
You may cancel at any time via the customer portal (Stripe). Cancellation takes effect at the end of your current billing period; you retain paid access until then. We do not provide partial-period refunds except as required by law (see Section 4.7).
4.7 Refunds and consumer rights
If you are a consumer in the UK or EU, you have a statutory right to cancel a new purchase within 14 days. Where you ask us to start your paid access immediately, you agree that we may begin providing the service within this 14-day period. If you then cancel within those 14 days, we will refund you less a proportionate amount for the paid access you have already had — that is, a pro-rated refund for the unused part of the period. Nothing in these Terms affects your non-excludable statutory rights under the Consumer Rights Act 2015 or equivalent local consumer law.
5. Acceptable use
You agree not to:
- use the Service for any unlawful purpose or in breach of any applicable law;
- scrape, harvest, resell, or systematically extract data from the Service beyond normal personal use;
- circumvent, disable, or interfere with quotas, rate limits, security, or access controls;
- reverse-engineer, decompile, or attempt to derive source code, except where permitted by law;
- upload malicious code or attempt to disrupt or overload our infrastructure;
- use automated means (bots, scrapers) to access the Service except as we expressly permit;
- resell, sublicense, or commercially redistribute the Service or its data without our written consent.
We may suspend or terminate access for breach of this section.
6. Data accuracy and no reliance
The Service aggregates pricing and market data from third-party sources (including PriceCharting, eBay, and others). This data may be incomplete, delayed, estimated, or inaccurate, and market prices are volatile.
The Service is provided for informational purposes only and does not constitute financial, investment, or trading advice. We make no representation or warranty that any price, valuation, deal indicator, or grading recommendation is accurate, current, or suitable for any purpose. You are solely responsible for any buying, selling, grading, or investment decisions you make. Do not rely on the Service as your sole basis for any transaction.
7. Intellectual property
The Service, including its software, design, and original content (excluding third-party card data, names, and images), is owned by Poketrax and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your own personal, non-commercial use in accordance with these Terms. You retain ownership of the collection data you input; you grant us a licence to host and process it to provide the Service.
8. Third-party services and links
The Service relies on and links to third-party services and data sources. We are not responsible for the content, availability, accuracy, or practices of any third party. Your use of third-party services (e.g. Stripe, eBay listings) is governed by their own terms.
Some outbound links (for example, to eBay listings) are affiliate links: if you click through and buy something, we may earn a commission at no extra cost to you. This never affects the prices, valuations, or rankings we show you.
9. Availability
We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service, with or without notice, including for maintenance. We are not liable for downtime caused by third-party providers or events outside our reasonable control.
10. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement. This does not exclude any warranty or right that cannot be excluded under applicable law.
11. Limitation of liability
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot lawfully be excluded.
Subject to that, to the maximum extent permitted by law:
- we are not liable for any indirect, incidental, special, or consequential loss, or for loss of profit, revenue, data, goodwill, or anticipated savings, or for losses arising from buying/selling/grading decisions based on the Service;
- our total aggregate liability arising out of or in connection with the Service in any 12-month period is limited to the greater of (a) the total fees you paid us in that period, or (b) £100.
12. Indemnity
You agree to indemnify and hold us harmless from any claims, losses, or costs (including reasonable legal fees) arising from your misuse of the Service or breach of these Terms, to the extent permitted by law.
13. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. On termination, your licence to use the Service ends; sections that by their nature should survive (e.g. 6, 7, 10, 11, 12, 14) continue to apply.
14. Governing law and jurisdiction
These Terms and any dispute arising out of them or the Service are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer, this does not deprive you of the protection of the mandatory consumer-protection laws of your country of residence: if you are resident elsewhere in the UK or in the EU, you keep the benefit of those mandatory provisions and may bring proceedings in your home jurisdiction.
15. Changes to these Terms
We may update these Terms from time to time. We will post the updated version with a revised "Last updated" date and, for material changes, notify you by email or in-app notice. Continued use after changes take effect constitutes acceptance.
